Hello, I'm new here and am trying to find information about the patent status for Abraham Darby. I have searched for it and clicked on the USPTO patent button, but the requests returns an error, "too many requests". Maybe I'm not using the site properly? Any help on either is appreciated.

Thanks.

If by "patent status" you mean, Can you propagate AD, yes you can. PVP lasts 20 yrs., US patent was issued in 1989 and would have expired in 2009. If you want to sell it you might have to use the AUSname, but those names have proved no barrier to Ebay sellers who have making a lot of money on off patent English roses.

Yes I am asking if I can propagate and sell. I also wondered about the name as I have read they can be trademarked and those last longer than the patent. I'll use the AUScot registration name.

Thank you very much.

Ok my decision is taken , after 3 years of fight with black spot on my Abraham Darby , I decide to remove it from my garden . I am going with a no spray garden rose and this is a black spot magnet ! Very sad because I loved it flowers and fragrance but I am happy I took this decision . I will replace it with Princesse Charlene de Monaco , which is as beautiful and never have black spot and has a very good fragrance .

Maybe that's my favourite English Rose.
I have a two-years old plant (on R. multiflora rootstock) grown in a 7-gallon container in a full-sun position. It forms a dense, short shrub. Stems are armed with large, red thorns. Very attractive dense, glossy leaves. Very continuously flowering, flower quality is OK in a rainy summer with almost no maintenance. Exceptional large, splendid, fragrant flowers with tender yellowish-pink color. Susceptible to blackspot but mended quickly when sprayed. Very vigorous growth but seems difficult to form a climber.
